In the name of God amen: the Twelf daye of December in the yere of our lord god a thowsand fyve hundrithe and thre score.
I Franncis Hewett of Wales in the Countie of Yorke Esquire beinge sik of body, but of hole and perfyte memory thankes be geven to Allmightie god do make this my testament and last will in maner and form followinge.
First I comytte my sowle to Allmightie god my creator and redemer and my body to be buryed in the Church of Saynte Swythine in Wales within the prebend of leyghton. And for my mortuary accordinge to the lawes of the Realme also I geve and bequeathe unto the Churchwardens of Wales for the use and behos of the churche ten shillinges.
Also I geve and devyse all that my moyetie of the Mannor or lordshippe of barle borough with all and singuler th[e ]appurtenances to be solde by my executors or by the survyves or survyvee of them, and the money therefore receyved to be bestowed and imployed to th[e ]uses and intentes hereafter in this my will expressed. And if John Selyok his heyres executors or assignes do paye or cause to be payed to my executors or assignes at my owne dwelling howse in Wales on or before the feaste of the puryficacion of our lady commonly called Candelmas next followinge the some of two hundrethe poundes of good and lawfull englisshe money and at or before the said feaste of the puryficacion of our lady which shall be in the yere of our lord god a thowsand fyve hundrithe thre score and one another hundrithe poundes lyke lawfull englyssh money, that then he shall have the preferment of the said bargayne and that then my executors or the suvyvers or survyvee of thyem shall lawfully assine the said moyetie to the said John and his heyres for ever. Any in case the said John Selyo[k] refuse to paye so muche money at either of the dayes as is aforesaid, then I will that John Hewet my sonne do within eight dayes after every of the said feastes paye the said severall somes of money in maner and forme as is aforesaid, then he shall have the preferment of the said bargayne. And in case the said John Hewet my sone do refuse to paye so muche money at either of the dayes as afore is rehersed then I will that if Robert Sawnderson do within sixtene dayes after every of the said feastes pay the said severall somes of money in maner and forme as is aforesaid then he shall have the preferment of the said bargayne.
Also I will and bequeathe unto William Hewet sonne and heyre unto my son John Hewet of london and to his heyres for ever all my landes called Wodse[ttes] lyenge and being within the Lordeshippe of kynwalmarsshe within the countie of Derbye after the deathe of Isabell my wyf.
Also I will and bequeath unto Leonerd Hewet my sonne and to his heyres for ever thre closes called the broad meadow upon condicion that he do paye or cause to be payed unto Richard Rodgers so muche money [as] apperethe by wryti[nge] made betwene me and the said Richard.
Moreover I will and bequeathe to Thomas Hewet my son and to Mawde Hewet my doghter and to their heyres for ever all my landes with th[e ]appurtenances in Southanston in the countie of Yorke in full concentary [?? obscured by fold] and payment of their childres porcions. Provided allwayes that if Richard Penny do paye unto the said Thomas and Mawde at or before the feaste of Phillippe and James the apostles comonly called Maye Daye the following [some?] of fortye markes of good currant money of englond then [fold] that the said Richard Penny shall have agayne to him and his heyres for ever all suche landes tenements and heredytamentes with ???? as I the said Franncis Hewet had or did lately purchase of the said Richard within the said towne.
Also I will and bequeathe to George Hewet second sonne of Jefferey Hewet [fold] landes and tenementes in Fyrbecke in the Countie of Yorke duringe his naturall lyf and after his decease I will that Franncis Hewet his elder brother shall have the foresaid landes and tenementes in Fyrbecke aforesaid to him and his heyres for ever.
Also I will and bequeathe unto John Hewet the sonne of Jefferey Hewet one annewetie or anuall rent of Twenty six shillinges and eight pence to be taken of and in one tenement in Wales aforesaid now in the tenure of Elizabeth Bill[inges?] Widow with a clause of distres for non payment of the said rent.
Also I will and bequeathe unto Katheryn Hewet my dowghter one hundrithe poundes so that [the] maryage betwene George Selyoke and her do take effect and if it do not take effect then I will that the said Katheryn shall have but one hundrithe [marks?]. And the said legacie to be taken as parcell [?] of the said money to be receyved for the said moyetie of the said Mannor of barleboroughe. Also I will and bequeathe unto John Hewet my sonne one hundrithe markes to be taken in lyke sorte. Also I will and bequeathe unto Leonerd Hewet my sonne one other hundrithe markes to be [fold] of the said landes in Barleboroughe aforesaid in lyke sorte. Also I will that if the moyetie of the said Mannor of Barleborough can not be solde for the some of thre hundrithe poundes as is aforesaid, that then my said sonnes John Hewet and Leonerd Hewet shall take no benefyte of their said severall legacies but in maner and forme hereafter to be exp[fold]. That is to saye the said Nicholas Anthony and Katheryn my children aforesaid to have and enioye [enjoy] their severall porcions accordinge to their said severall legacies and for the residue of the said some of money to be taken for the said moyetie of the said manor to be equally devyded betwene John Hewet and Leonerd Hewet aforenamed [in tiny writing inserted: have and enioye the said residue of money in full satisfaction of their said [fold] aforenamed] [fold].
Moreover I will and bequeathe unto Prudence Hewet my dowghter forty poundes and one cowe the best she will chewse for her hole childes porcion.
Also I bequeath unto Katheryn Hewet my dowghter one cowe all which legacies before bequeathed unto my said dowghter Ketheryn I will that she shall have in full satisfaction for her chyldes porcion.
Also I will and bequeathe unto Thomas Hewet my grey geldinge with saddell and brydell, two bullockes of two yeres olde and two quyes [???] of the same age and six ewes in recempt [??] his chyldes porcion.
Also I will and bequeathe to Mawde Hewet my dowghter two qwyes of two yeres olde and six ewe shepe for her chyldes porcion.
Also I bequeth to E[d?]ward Rye my sonne in lawe my grey geldinge.
Also I will and bequeathe to Franncis Hewet sonne of Anthony Hewet one qweye of two yeres olde and foure shepe.
Also I will and bequeathe to Roger Sheme [??] one close in the broade meadowe now in the occupation [?] of the said Roger for five yeres payenge therefore yerely during the said terme Twenty shillinges unto Leonerd Hewet my sonne.
Also I will that Isabell my wyf shall have two closes in broad meadowes duringe her naturall lyf payenge therefore yerely duringe the said terme unto my said sonne Leonerd Hewet fowre markes rent. Also I will and bequeathe unto Mathew Beamont of Wales [fold] shillinges of gold. Also I will and bequeathe unto Thomas Busby Clarke ten shillinges of golde.
Also I will and bequeathe towardes the mendinge of the high waye to the said towne to the churche and my howse ten shillinges.
Also I will and bequeath to every Cottage howse in the Towne of Wales Twelve pence. And to every god chylde that I have in the said towne a shepe.
Also I will and bequeathe unto every of my sarvantes as well here as at Netherthorpe every of them a shepe.
Also I will and bequeathe unto Henry Spencer one shepe. Also to Willyam Watson wyf one ewe and a lambe and to Jeffrey Watson her sonne one ewe and a lambe.
Also I will and bequeathe to my Lord Darcy the baye gedinge with the whyte face. Also I will and bequeathe unto my lady Darcy two Ryalls of golde so that she repaye unto myne executors the some of ten pounds which [fold] her.
Also I will and bequeathe unto Henry Sandford one bullok. Item to Henry Skelton two ewes.
Also I will and bequeathe unto Franncis Hewet sonne and heyre of Jefferey Hewet all such wryting obligacions dedes and escriptes made betwene the late Sir George Darcye knight Lord Darcy of the one partie and me the said Franncis Hewet of the other partie and that the said Franncis sonne of Jefferey shall take and have all suche advanntages comodeties and debtes as by the said wrytinges or any of the [fold] growen or hereafter might or sholde have come or growen unto me the said Franncis by ex[??] in respect thereof.
Also I will and bequeath to Anthony Hewet my br[other] my howse wherein I now dwell with all my copyeholde landes and meadows with all and singuler their appurtenences within the Lordshippe of Wales during the mynoretye of Franncis Hewet sonne and heyre of Jefferey Hewet payenge yerely unto the said Franncis six poundes thirtene shillinges and fowre pence good & lawfull money of englond at the usuall feastes in the yere that is to saye at the feastes of Penthecost and Saynte Martin in winter by even porcions.
Also I will and bequeathe unto [the said] Anthony my brother two bullockes of two yeres olde. Also I will that my said brother Anthony shall educate and bringe up George Hewet and John Hewet sonnes of Jefferey Hewet in suche sorte as he dothe his owne children during the mynoretie of Franncis Hewet their elder brother.
Further I geve unto Isabell my wyf so muche goodes and cattalls and to suche valew as she was possessed of at the tyme of our entermaryage and the same to be taken and rated under her accordinge to the discression of my nephew Franncis Rodes and my cousin Anthony Eyre for and in consideracion that she shall content and paye so muche money as yet remayneth to be payed to the said Franncis Rodes for the dischardge of his wyfe’s porcion. And for the furder consideracion thereof and to the[ i]ntent also that she shall be good mother and frende unto my dowghters Mawde and prudence I geve unto my said wyf suche bondes and debtes as be [coming?] and payable unto me by Edmund Mearynge and Nicholas Jepson and by either of them. Further I will that my said wyf shall have the custodye of suche porcions of money and [fold – order of such landes?] to the use of the said Mawde as by this my will be geven unto my said dowghter Mawde unto suche tyme as she shall be maryed or else come to the age of eightien yeres. All my legacies so appoynted to my wyf she to take and have in full satisfacion all the interest or title that she in any wyse maye clayme of any my goodes or chatells, except suche certayne Juells which all ready I have geven unto my cosyn Anthony Eyre to her use, and which said Juells I lykewyse geve unto her by this my will, in case the said former gifte be not good in lawe.
Also I will one annewetie or yerely rent of fortye shillinges to my dowghter Prudence for term of her lyf naturall to be payde unto her out of all my landes and tenementes which shall discend or come unto Franncis Hewet sonne of Jefferey when the said Franncis shall or sholde accomplisshe the age of xxi yeres.
Also I will and bequeathe unto my nephew Franncis Rodes (to the[ i]ntent he [fold] se him well brought up accordinge to his degre) the custody order governance and maryage of Franncis Hewet sonne of Jefferey Hewet duringe his mynoretie unto [fold] tyme as he shall come to his full age of xxi yeres. And in case that he will not be maryed accordinge to the nominacion and pleasure of my said nephew Rodes then will the proffite of all suche landes as shall come unto him by discent from me shall be levyed and taken by my said nephew Rodes and my brother Anthony Hewet [fold] by the space of thre yeres next after that the said Franncis Hewet shall come to the age of xxi yeres the said proffites to be levyed and taken by them to be equally devyded amongest suche of my children as shall be their discressions stand moste nedefull thereof.
Also I do ordeyne constytyte and make John Hewet my sonne Katheryn Hewet my dowghter and Anthony Hewet my brother my true and lawfull executors of this my said will and testament. Of which said will and testament I do lykewyse ordeyn and make my nephew Franncis Rodes supervysor, to whome for his paynes in that behalf I geve and bequeathe unto him [fold] besydes his costs and chardges therein to be susteyned two bullockes.
In witnes whereof to this my last will and testament I the said Franncis Hewet have set my seale and subscribed my name to daye and yere above written, Franncis Hewet, in the presence of us Rodes [Francis Rodes?], Anthony Eyre, Edward Rye, Richard Cockes, Thomas Gudryche
